Chief Justice Koome’s Call: Judges Urged to Fearlessly Fulfill Their Duties

Execute your duties without fear, Koome tells judges

Summary:

Chief Justice Martha Koome reaffirms judicial independence amid accusations, encouraging judges to carry out their duties without fear or favor. President Ruto alleges collusion with cartels to obstruct projects.

Chief Justice Martha Koome has issued a resolute call for judges to uphold judicial independence without fear or favor. This comes in response to accusations that the Judiciary is hindering government projects, as claimed by President William Ruto, who alleges collusion with powerful entities.

In a statement on Wednesday, Chief Justice Koome, who also serves as the President of the Judicial Service Commission, asserted the Judiciary’s commitment to promoting independence, as outlined in Article 172(1) of the Constitution.

She expressed concern over judges facing criticism for perceived opposition to state programs and urged them to execute their duties with integrity.

President Ruto, speaking at the burial of Senator John Methu’s father, accused judicial officers of collaborating with powerful cartels to obstruct state projects. Ruto highlighted instances, including the National Hospital Insurance Fund, where he alleged the misuse of court orders to impede reforms.

He also claimed interference in the housing program, emphasizing the need to curb judicial impunity while safeguarding the Judiciary’s independence.

In late 2023, courts issued orders halting the implementation of the 1.5% housing levy and three Health Acts. Chief Justice Koome’s call serves as a reaffirmation of the Judiciary’s dedication to upholding constitutional principles in the face of external pressures.
